On Friday, the most important Supreme Court decision in decades was handed down, a 6-3 ruling overturning Roe vs. Wade. For nearly half a century, women had a constitutional right to abortion, now they don’t. Because, as Justice Samuel Alito wrote in the majority opinion, Roe was “demonstrably wrong all along.” Informed by what he called, “unusually weak reasoning.” The new court ruling abandoning what appeared to be a well-established precedent is sure to inflame passions. And as Biden insisted, the fight is not over. His administration, with the support of virtually every Demacrat in Congress, will seek to pass a federal law codifying abortion rights. But even if such legislation could overcome a near-certain filibuster from Senate Republicans and actually pass, would it supersede the actions of more than a dozen state legislatures that now seemed poised to ban abortion outright? David Kaplan, veteran Supreme Court observer and author, and former Deputy Attorney General Donald Ayer, himself a former Supreme Court clerk, join to discuss it alongside extraordinary testimony before the January 6 Committee this week.
